2. User Agreement
The following Terms describe the terms and conditions on which we offer you access to our Services, defined below. If you do not agree to be bound by these Terms in their entirety, you must cease accessing or otherwise using the Shellix site and Services in any way. You must not under any circumstances seek to undermine the security of the Shellix Site or any information submitted to or available through it. You are solely responsible for any content submitted by you to this Site and should ensure all contents supplied are true, accurate, up-to-date, and not misleading or likely to mislead or deceive any user. Nor should you supply information that is discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful, or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trademark, or other intellectual property rights of any person in any jurisdiction. We reserve the right to remove any information supplied by you from the website at our sole discretion, at any time and for any reason without being required to give any explanation.

We may collect and store personally identifiable information about you when you visit the Shellix site (“personal data”). This information may include but is not limited to, URL, domain name, I.P. Address, or email address. We may use this information to provide our services to you or contact you about various services from time to time and to improve the Shellix site and improve user interaction based on the information collected. 4. Generally
You can access features through the Service that allow you to view transact online with local businesses, shops etc. These features may be provided by Shellix’s third-party partners, including through iframes or similar formats, and their use may be governed by different or additional terms presented to you as part of the business directory listing or transaction process. Please note that such third-party themselves are responsible for fulfilling the service or products offered by these listings.
5. Who We Are
We provide a business directory service ("Shellix services") scrapped automatically from third-party sites, via the Shellix website accessible at https://Shellix.xyz. We are a directory listing website for external shops, using scrapping in which we collect data from third-party such as sellix.io, shoppy.gg, atshop.io and selly.gg stores etc. and we display it on the Shellix.xyz website so users can find products by name, seller, etc.
6. The Shellix Feature
Shellix provides our esteem users a Freemium Feature where users can add their shop URL to be crawled (scrapped) section on the Shellix website, users can filter products, check feedbacks and any other information displayed in the scrapped store. Users can also add comments about a specific product with the Shellix feature.
7. Paid Feature
Users can purchase a key on our site to promote their products, which will get displayed on our main page (randomly up to demand, max 8 products displayed) and get priority in our search engine. Please read the Shellix Key section for more information.
8. Data Collection
If you create a user account via the Shellix website, you may be required to submit information and content to the Shellix Services, such as PII (personal identifying information), encrypted data, communications and usage data, all of which qualifies as ‘User Data’. All data collected on the Shellix platforms complies with the Peruvian Legislation on Personal Data Protection Law – Law Nº 29733 and Requirements. By using our services, you understand that the Shellix, shall have access to view and use your User data to understand trends etc without identifying user actual names and locations. We will act as your data controller and we will treat your personal information with utmost care and privacy. We will not sell your data and will not disclose your data without your express consent and permission. Please see our Privacy Policy page for more information.
9. Eligibility for Access
By accessing and using the Shellix site, you acknowledge and agree that you are representing to us that you are over the age of 18 and you are of legal age to form a legally binding contract.
10. Posting content
Shellix allows you to post content, including photos, comments, links, and other materials. Anything that you post or otherwise make available on Shellix is referred to as "User Content." You retain all rights and are solely responsible for, the User Content you post to Shellix.
11. Shellix Key
We provide a key feature where users can purchase a key from an authorized third-party Sellix.io for promotion purposes to get priority in our search engine while using the Shellix website. Shellix.xyz does not distribute the key directly but through a third-party provider known as Sellix.io. Please make sure you read up the Sellix.io terms of service and privacy policy before proceeding to purchase the key. Any key that Shellix might issue via a third party for use in connection with the Service is non-transferable (unless required by law), and not redeemable for cash or any other consideration unless otherwise specified. If your Account is terminated you will not be able to use any unexpired and unused keys, and any such key will automatically terminate and cannot be redeemed unless required by law.
12. Your Content
Many of our Services allow you to store or share Your Content or receive material from others. We don’t claim ownership of Your Content. Your Content remains Your Content and you are responsible for it.
• When you share Your Content with other people, you understand that they may be able to, on a worldwide basis, use, save, record, reproduce, broadcast, transmit, share and display Your Content for the purpose that you made Your Content available on the Services without compensating you. If you do not want others to have that ability, do not use the Services to share Your Content. You represent and warrant that for these Terms, you have (and will have) all the rights necessary for Your Content that is uploaded, stored, or shared on or through the Services and that the collection, use, and retention of Your Content will not violate any law or rights of others. Shellix cannot be held responsible for Your Content or the material others upload, store or share using the Services.
• To the extent necessary to provide the Services to you and others, to protect you and the Services, and to improve Shellix products and services, you grant Shellix a worldwide and royalty-free intellectual property license to use Your Content. We do not use what you say in email, chat, or your documents, photos, or other personal files, to target advertising to you. Our advertising policies are covered in detail in the Privacy Statement.
13. Communications from Shellix and Others
By accessing or using the Service, you consent to receive communications from other users and Shellix through the Service, or through any other means such as emails, push notifications, text messages (including SMS and MMS), and phone calls. These communications may promote Shellix or your business listed on Shellix.xyz, and may be initiated by Shellix, businesses listed on Shellix, or other users. You further understand that communications may be sent using an automatic telephone dialing system and that you may be charged by your phone carrier for certain communications such as SMS messages or phone calls. You agree to notify us immediately if the phone number(s) you have provided to us have been changed or disconnected. Please note that any communications, including phone calls, with Shellix or made through the Service may be monitored and recorded for quality purposes. You can opt-out of certain communications by sending Shellix an opt-out message at [email protected].
14. Responsibility for Your Content
You alone will be responsible for Your Content, and once posted to Shellix, it cannot always be withdrawn. You assume all risks associated with Your Content, including anyone’s reliance on its quality, accuracy, or reliability, and any risks associated with the personal information you disclose. You represent that you own or have the necessary permissions to use and authorize the use of Your Content as described herein. You may not imply that Your Content is in any way sponsored or endorsed by Shellix.
15. Our Right to Use Your Content
We may use Your Content in several ways, including by publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their websites and media platforms (“Other Media”). As such, you hereby irrevocably grant Shellix worldwide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use Your Content for any purpose. Please note that you also irrevocably grant the users of the Service and any Other Media the right to access Your Content in connection with their use of the Service and any Other Media. Finally, you irrevocably waive and cause to be waived, against Shellix and its users any claims and assertions of moral rights or attribution concerning Your Content. By “use” we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyze, commercialize, and prepare derivative works of Your Content.
16. Content Subjectivity Disclaimer
Content tends to elicit varying reactions among different people. You may come across Content that you find offensive, indecent, explicit, or objectionable. Also, Content types, genres, categories, and descriptions are provided as suggestions to help with navigation, and Shellix does not guarantee that you will agree with them. You acknowledge these risks.
17. Third-party Advertising
Shellix may publicly display advertisements, paid content, products, seller links, and other information nearby or in association with Your Content. We have no relation with the sellers nor products listed in our directory. Those products are automatically scraped from third-party websites such as shoppy.gg, sellix.io, atshop.io, and selly.gg so their contents or links are not in our absolute control and we can not take responsibility for what's displayed through these sites. Shellix takes no responsibility for and does not endorse any third-party advertisements or any third-party material posted through the Shellix website, nor do we take any responsibility for the products or services provided by these advertisers. Any dealings you have with advertisers while using Shellix Services, including through engaging with interactive advertisements, are between you and the advertiser, and you agree that Shellix is not liable for any loss or claim that you may have against an advertiser. If you provide any confidential or personal information or engage in any transaction through an advertisement, Shellix is not responsible for such information or transaction and we encourage you to read the terms of use and privacy policy of the advertiser or other party collecting such information or engaging in such transaction.
18. Other Party
Shellix may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Shellix. We don’t endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content from Shellix, you do so at your own risk and you agree that Shellix has no liability arising from your use of or access to any third party website, service, or content
19. Copyrights Infringement Policy
Shellix are strongly against the exploitation of someone else's intellectual property or Copyright. If you believe any contents of the Services violate your copyright, please notify our copyright agent in writing or contact the third-party site in question, since the Shellix website content is a combination of different authorized third-party known as shops. However, the contact information for our copyright agent is at the bottom of this section. For us to take action, you must do the following in your notice:
• Provide your physical or electronic signature;
• Identify the copyrighted work that you believe is being infringed;
• Identify the content that you think is infringing your work and include sufficient information about where the material is located so that we can find it;

You agree to follow Shellix Infringement Policy in notifying us about copyright and trademark disputes concerning User Content. You agree Shellix may forward any notification sent pursuant to our Infringement Policy to the user who submitted the User Content at issue.
21. Acceptable Use Policy
The following sets forth Shellix “Acceptable Use Policy”: You agree not to use the Shellix site or Services to collect, upload, transmit, display, or distribute any User Content
• No Fraud: we do not tolerate Fraud in any capacity
• No Interference. You may not interfere with any other user's ability to use or enjoy our Services.
• Don't Damage Our Services or Servers. You may not post or facilitate the distribution of software viruses or any computer code designed to disrupt, damage, or limit our Services' or obtain unauthorized access to our Services or Content or any data or other information of any third party.
• No Unauthorized Access. You may not attempt to gain unauthorized access to other computer systems or networks connected to our Services or use our Services, Content, or any information contained therein for any unlawful purpose. Shellix, in its sole and absolute discretion, shall determine whether any content you transmit or receive or your use of our Services violates this provision.
• No Collection of Personal Information from Other Users. You may not collect information about other users of our Services or use any such information to transmit or facilitate the transmission of unauthorized or unsolicited advertising, junk or bulk email, chain letters, or any other form of unauthorized solicitation.
• Follow These Terms of Use and Conduct Rules. You may not take any action on or through our Services that violates any applicable law or these Terms of Use. If You violate these platform guidelines, we reserve the right to remove You and any of Your Content from the Shellix Platform. Whether conduct violates, our rules of conduct will be determined at Shellix's sole discretion.
22. Business or Third-Party Provider Terms
In order to access or use the Services to post or list contents about your business, you agree that: i. you have the authority to act on behalf of the business or entity associated with or claimed through your Account and bind any such business (including any corresponding entity) to the Business Terms (such business or entity, your “Business”); ii. your access to or use of the Shellix Site will only be in your capacity as an authorized representative of your Business; iii. you will not use the Shellix Site for business activities, including but not limited to flagging reviews or messaging people who have reviewed your Business; iv. your Business complies with applicable laws and does not offer, advertise, sell, or lease illegal products and/or services; v. you grant Shellix a non-transferable, non-exclusive, royalty-free limited license to display your public website on the Services, or allow for its display through iframes or other framing technology; vi. you agree that we may contact you, including by phone or email, using the contact information you provide us, make publicly available, or that we have on record for your business, and that our communications (including phone calls) with you may be monitored and recorded for quality purposes; vii. attempt to generate automated, fraudulent, or otherwise invalid ad impressions, inquiries, conversions, ad clicks, or other actions; viii. use any Shellix trademark or service mark in any manner without Shellix’s prior written consent.
23. Intellectual Property
Shellix retains all right, title, and interest in the performance of the services, including response times, load averages, usage statistics, and activity logs, (collectively, “Usage history”) Usage Information, and any derivative works thereof. You will not copy or transmit any of the material except if you are doing so for your personal, non-commercial use. All copyright, trademark, and other proprietary rights notices presented on our application must appear on all copies you print. Other non-Shellix products, services, or Shellix designations on our website belong to those respective third parties and may be mentioned on our website for identification purposes only. You should contact the appropriate user for more complete information regarding such information and their product description. Your use of and access to our website does not grant you any license or right to use any of the marks included on our website.
24. Disclaimer
Your use of the Site is at your sole risk. The Site, and its content, are delivered on an "as is" and "as available" basis. Shellix makes no warranty that the Site or any related service provider, nor sellers listed in our directory, will be error-free, uninterrupted, timely, secure, or that it will provide specific results from use of the Site or any content, search or link therein. Any material viewed, products, sellers, or otherwise obtained through the use of the Site is done solely at your own discretion, and Shellix will not be liable for any damages of any kind arising from the use of the Site, including, without limitation, direct, indirect, incidental, punitive, or consequential damages. No advice or information, whether oral or written, obtained by you from Shellix or through or from the Site shall create any warranty not expressly stated in the Terms and Conditions of Use. Data and information relating to securities or otherwise is provided for informational purposes only and is not intended for trading purposes. Neither Shellix.xyz nor any of its data or content providers shall be liable for any errors or delays in the content, or any actions taken in reliance thereon.
25. Limitation of Liability
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Shellix site, Services. Neither Shellix nor any other party involved in creating, producing, or delivering the Shellix, Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage, or system failure or the cost of substitute products or services, or any damages for personal or bodily injury or emotional distress arising out of or in connection with these Terms.
26. Refunds

27. Indemnity
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any case without the prior written consent of Shellix. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
28. Your feedback
We encourage you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. By submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.
29. Our GDPR and FDPA Data Protection Compliance
We are committed to protecting the privacy of your personal information and that of our participants. By using the Shellix.xyz Services, You acknowledge and agree to Shellix.xyz collection, usage and disclosure of personal information is governed by the Peruvian Legislation on Personal Data Protection Law – Law Nº 29733 Requirements and the European Union GDPR Data protection regulation. We collects and uses personal data of users to the extent that is necessary for the creation, design of content or modification of the contractual conditions for competition services on the Shellix.xyz Website. To this end, Shellix’ Data Protection Officer (DPO) constantly ensures compliance of all personal data processing in progress within Shellix operations. Also, Shellix certifies the following:
• We have implemented appropriate technical and organizational measures to ensure and be able to demonstrate that the processes are carried out under the GDPR and the Peruvian Legislation on Personal Data Protection when it acts as the data controller.
• We will provide sufficient guarantees as to the implementation of appropriate technical and organizational measures so that any processing of personal data meets the requirements and guarantees protection of the rights of the person in question when acting as a subcontractor.
• In the event of subcontracting, it retains only those subcontractors who provide sufficient guarantees that appropriate technical and organizational measures will be implemented so that any processing of personal data meets the requirements and guarantees protection of the rights of the person in question
• Lastly, Shellix undertakes to implement appropriate technical and organizational measures to retain personal data for the duration stipulated depending on the nature of said data. Shellix is committed to protecting the data of your personal information and that of our users. By using Shellix Services, You acknowledge and agree that Shellix collection, usage, and disclosure of this personal information is governed by our Privacy Policy. Additionally, if: (a) You are established in the European Economic Area (EEA); (b) You provide Shellix Services to customers in the EEA; or (c) You are otherwise subject to the requirements of the EU General Data Protection Regulation GDPR and the Peruvian Legislation on Personal Data Protection Law – Law Nº 29733 and Requirements, Shellix’ collection and use of personal information of any European residents are also subject to our Data Processing Addendum.
30. Choice of Law
This agreement And the Relationship between You and Shellix Shall be governed by The Supreme Court of Peru. Any disputes relating to these terms and conditions shall be subject to necessary Arbitration. If you think it fails to satisfy the law of your jurisdiction, we should like to hear from you. However, ultimately it is your choice as to whether you wish to use our website.
31. Ownership
The Shellix site, Services and Shellix Content are protected by the Peru copyright law, trademark, and other laws of foreign countries.
